17. contact information

The failure of either party to enforce any right or provision in these Terms will not constitute a waiver of that right or provision.

(D) WAIVER

The licenses we grant you are for you and you alone. You may not transfer or assign these Terms without our express written consent.

If any provision of these Terms is held unenforceable, that provision will be modified only to the extent necessary to make it enforceable, and the remaining provisions will continue in full force.

Any claim arising from your use of the Service must be filed within one (1) year after the cause of action arose. Claims filed after this period are permanently barred.

You agree to indemnify, defend, and hold Mix & Mesh, its owners, employees, contractors, and agents harmless from and against any and all claims, damages, losses, and expenses arising directly or indirectly from your use of the Service or your breach of these Terms.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. MIX & MESH MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR SUITABILITY OF ANY CONTENT PROVIDED THROUGH THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIX & MESH SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE.

We do not guarantee any specific outcome, result, or financial savings from use of the Service. Home projects involve many variables outside our control.

13. no warranties and limitation of liability

We reserve the right to modify, update, or discontinue the Service, or any features or portions thereof, at any time without prior notice. We also reserve the right to terminate your access to the Service at any time for any reason, including breach of these Terms. In the event of termination due to a breach, no refund will be issued.

12. modifying or terminating service

The Service uses third-party platforms including but not limited to Telegram (private channel access), HighLevel (customer management, checkout, and member access), Stripe (payment processing), Netlify (file hosting), and Showit (website hosting). We are not responsible for the availability, performance, or policies of these third-party platforms. Your use of these platforms is subject to their own terms of service and privacy policies.

11. third party platforms

To access certain portions of the Service, you may be required to provide your name, email address, and other information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account at support@mixandmesh.com.

10. creating an account

The Home Insider Pass and individually purchased digital tools are one-time purchases for a fixed duration. They are not recurring subscriptions and do not auto-renew. No cancellation is required. Your access simply expires at the end of the stated period.

(c) cancellation and expiration

Because our products are digital and access is granted immediately upon purchase, all sales are final.

For The Home Insider Pass only, you may request a refund within 7 days of your purchase date if you have not accessed the digital tools and have not sent any messages in the private channel. Once the tools have been accessed or the channel has been used, the sale is final and no refund will be issued.

Digital tools and calculators purchased individually are final upon purchase and are not refundable, as the full value of the tool is available immediately on access.

To request a refund where one is available, contact us at support@mixandmesh.com with your name and order details. Approved refunds are processed within 5 to 10 business days.

We may issue a refund outside this policy at our sole discretion. Doing so in any individual case does not waive our right to enforce this policy.

(B) Digital Products & refund policy

All purchases made through the Service are subject to these Terms. By completing a purchase, you authorize Mix & Mesh to charge your selected payment method for the amount stated at checkout. All prices are in USD.

The Service is designed to provide homeowners with educational guidance and tools to help them navigate the home building and remodeling process. It is not designed to replace a licensed interior designer, architect, general contractor, or other construction professional.

Mix & Mesh does not: produce architectural drawings, construction documents, or design deliverables; manage contractors on your behalf; provide licensed design or construction services; or guarantee any specific outcome for your project.

The guidance provided through the Service reflects general industry knowledge and experience. Every project is unique. Results will vary based on your specific circumstances, team, budget, and decisions.

8. NATURE OF SERVICE

The data sets, multipliers, formulas, methodology, and code underlying our tools are our proprietary property and are not licensed to you. You may use tool outputs, including exported files, for your own projects and for projects you perform for clients. You may not extract, redistribute, or reverse engineer the underlying data or methodology.

Tool data is reviewed and updated periodically. Outputs reflect the data edition current at the time an estimate is generated. We may update, correct, modify, or discontinue any tool at any time. We do not warrant that any output is accurate, complete, or suitable for a particular project.

Our tools produce planning ranges derived from published industry and government data. Outputs are informational estimates only. They are not bids, quotes, appraisals, formal cost estimates, or professional advice of any kind.

Actual costs depend on your site, design, specifications, selections, builder, and market conditions at the time of construction, and will vary, in some cases significantly. Outputs may exclude major cost categories, which are identified within each tool.

You should not rely on any output as the sole basis for a financing, purchase, contract, or construction decision. Confirm all figures with a licensed builder, estimator, or other qualified professional before committing funds.

Digital tools are sold as time-limited access for the period stated at checkout. Access begins at the time of purchase and expires automatically at the end of that period. Access is personal and limited to one user. Sharing login credentials may result in immediate termination of access without refund.

7. DIGITAL TOOLS AND CALCULATORS

Communications within the private channel are confidential. You agree not to screenshot, share, or publish any portion of your channel conversations without express written permission from Mix & Mesh.

(E) privacy

You agree to use the channel respectfully and in good faith. Messages that are abusive, harassing, or otherwise inappropriate may result in immediate termination of your channel access and pass without refund.

We aim to respond to channel messages promptly. Response times may vary based on volume and availability. We do not guarantee same-day responses. The channel is not an emergency service and should not be used for urgent safety-related matters.

The channel is provided for questions relating to your own home building or remodeling project. It is intended for general guidance and is not a substitute for licensed professional services. We may limit or decline requests that fall outside the intended scope of the channel.

The Home Insider pass includes access to the digital tools available at the time of purchase. Mix & Mesh reserves the right to add, modify, or remove tools and content at any time. New tools added during your active pass period will be made available to you at no additional cost.

(d) included tools

Your pass is for your personal use only. It may not be transferred, shared, gifted, or resold. Access is limited to one user per pass. Sharing your access with any other person may result in immediate termination of your pass without refund.

(c) Non-transferability

If you hold an active pass and wish to upgrade to a longer duration, you may contact us at support@mixandmesh.com before your pass expires. Upgrades are prorated at our discretion. Upgrade pricing is not guaranteed and may change at any time.

The Home Insider is offered as a time-based pass. Pass durations and pricing are as stated at checkout at the time of purchase. Your pass begins on the date of purchase and runs for the duration you selected. Passes do not pause, freeze, or extend for any reason, including project delays, personal circumstances, or inactivity. If your project requires additional coverage beyond your pass duration, a new pass must be purchased.

All content provided through the Service is for educational and informational purposes only. It is designed to help homeowners navigate the home building and remodeling process and is not a substitute for licensed professional design, architectural, engineering, or construction services.

We retain all right, title, and interest in and to the Service and all related intellectual property, including but not limited to the Season Method framework, The Home Insider tools, guides, written content, and all other materials made available through the Service.

4. ownership

(a) Reselling, sublicensing, leasing, or otherwise redistributing access to the Service, whether or not for payment;
(b) Making a copy of the Service or any portion of it, except as allowed under these Terms;
(c) Sharing your pass access, login credentials, or channel access with any other person;
(d) Reproducing, distributing, or republishing any tools, guides, or content included in the Service;
(e) Extracting, scraping, reverse engineering, or attempting to derive the data sets, formulas, methodology, or code underlying the Service, or using them to build a competing product or service;
(f) Conducting any activity that is illegal, harmful, or otherwise violates these Terms.

For clarity, using outputs generated by our tools in the course of your own professional practice, including work performed for your clients, is permitted.

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your own personal or internal business purposes, including projects you undertake for your own clients. This license terminates if you interfere with our ownership rights or violate these Terms. The following activities may result in termination of your access:
